Welcome to our online store fibracreativa.com. This document details the conditions governing the use of this site. Please read it entirely to understand the terms of sale before making a transaction.

All content published on the site, especially drawings, texts, graphics, photographs, images, logos, is the exclusive property of AGILANDIA SL. Modification, exploitation, reproduction, distribution, or public communication of the content is prohibited without the express authorization of AGILANDIA SL.

3- Products, personalization, image rights

The greatest care is taken in the presentation and description of the products sold in the online store to best inform our Customers. AGILANDIA cannot be held responsible for minor variations in the finished products delivered.

Copyright and other intellectual property rights

We respect the intellectual property rights of others and ask our customers to do the same.

Our customers are responsible for the images, texts, and other content they upload to the site to personalize the products. By using this site, you agree to respect the copyrights of others and the applicable legislation. You must ensure that you legally have the right to reproduce the content intended to personalize a product on this site.

We use your content solely for the purpose of manufacturing the products and respect its confidentiality. It may be necessary to transmit the content provided by our customers to trusted suppliers who apply the same rules regarding copyrights and confidentiality in order to manufacture the products.

The Fibra Creativa PRINTS site may, at its sole discretion, close the accounts of users who, in its opinion, infringe copyrights, trademarks, or other intellectual property rights of others.

4- Order

You can choose to purchase as a registered user or guest. To buy a product, you must add the desired product to the cart, then fill out the order form and validate it by following the instructions. You will have the option to review the order details and total price, and correct any errors, before confirming it.

The validation of the order by the Customer explicitly implies knowledge and acceptance of these General Terms and Conditions of Sale.

The order form will ask you for personal data which will be incorporated into our database in order to process your order and facilitate possible new purchases on prints.fibracreativa.com. You can access and modify your personal data, and track your orders, in your account. It is important to fill in the requested fields accurately to avoid any confusion or incidents during the shipment of your order.

After confirming your order, you will receive a confirmation email summarizing the order (products, prices, quantity...). The Customer formally accepts the use of email for the confirmation of their order by prints.fibracreativa.com. The invoice will be available in the customer account after the order is shipped.

AGILANDIA will refuse any order from a Customer with whom there is a dispute or incident related to the payment of a previous order.

AGILANDIA also reserves the right to refuse any order that does not comply with the ordering process, or in the case of:

• excessively complicated or impossible to produce customized product, or if the Customer is unable to provide the images, information, or elements necessary for customization.
• product whose customization would involve infringement of third-party copyrights.
• product whose customization could constitute incitement to hatred.
• Product whose content is prohibited by law (child pornography)

The customer is solely responsible for the images, texts, and content they upload to the site to customize a product. AGILANDIA cannot be held responsible in any way for content uploaded to the site by its customers.

Orders are payable in full. No unpaid order will be manufactured or shipped. In the event that a paid order cannot be manufactured and shipped, the customer will be entitled to a refund of the amount or a credit.

V- Prices

Product prices are indicated in euros, excluding shipping fees. Prices are generally shown including VAT (tax included). The applicable VAT rate is the rate in effect in Spain (the general rate is currently 21%). Customers registered on prints.fibracreativa.com with a billing and shipping address (both addresses must be in the same country or two countries with the same customs treatment) located outside the European Union (Switzerland, Canada, or any other non-EU country) as well as customers located inside the EU but outside Spain who have a valid Intracommunity VAT number and provide it in the designated field see prices indicated excluding VAT. VAT will not be applied to their order.

AGILANDIA reserves the right to change its prices at any time. Products will be billed based on the rates in effect at the time the order is recorded, subject to availability.

6- Payment terms

The site offers several secure payment methods through Shopify Payments.

The data recorded and stored by the prints.fibracreativa.com site constitute proof of the order. The data recorded by the payment system constitute proof of financial transactions.

7- Shipping and delivery

The delivery time is the sum of the shipping time and the transport time.

The shipping time varies depending on the products.

- Non-customized products available in stock are shipped quickly.

- Customized products are made specifically for our customers, which involves a manufacturing time that depends on the product and the time of year. The average manufacturing time is indicated on the product pages, and you can find more information on the page "Shipping and delivery fees".

Although we do our best to quickly produce quality products, we do not control all parameters.A shipping delay does not in itself justify a refund of the order.

Transport time depends on the destination, chosen carrier, and time of year. An average time is indicated on the "Delivery and Shipping Costs" page and in the cart at the time of order confirmation. 

8- Exchanges, Returns, and Refunds

Our customers are asked to open packages upon delivery, check the contents, and report any issues to customer service as soon as possible.

For an exchange or return to be possible, items must not have been used; fabrics and other textile items must not have been cut or washed; kits must be complete.

8.1- Non-Custom Products

A non-customized product can be returned or exchanged within 21 calendar days from the delivery date. It must be returned in its original packaging and accompanied by the invoice or order confirmation, with return shipping costs borne by the customer.

After examining the product's condition, we will offer you a refund or credit if you wish, or send a replacement product in the case of an exchange.

8.2- Custom Products

Personalized items are neither refunded nor exchanged, except in the case of a significant manufacturing defect. If you believe your product has a manufacturing defect, contact us explaining the problem as precisely as possible, preferably with supporting photos.

The fact that the printed fabric does not exactly match the on-screen view or your expectations does not in itself constitute a defect, unless it is a printing defect (stripes, stains, smudges...).

Custom products are made from the files you prepare on the site using the customization tool. The preview is as accurate as possible, but fabric printing is never exactly identical to the on-screen preview. Any errors in texts, image framing, etc., are the customer's responsibility.

Limited variations in colors and dimensions cannot be subject to claims.

Fabrics shrink and some may also expand during printing, finishing, washing, and drying processes. No claims will be accepted for shrinkage or distortion of images within reasonable limits.

9- Protection of personal data

In accordance with the provisions of Law 15/1999, of December 13, on the protection of personal data, we inform you that all personal data provided will be included in an automated database, created and maintained under the responsibility of AGILANDIA. The information provided by the user is used by AGILANDIA to facilitate the processing of orders.

Our customers can exercise their rights of access, rectification, cancellation, and opposition at any time by email to info(a)fibracreativa.com.

10- Use of "Cookies"

The site prints.fibracreativa.com uses "cookies" in order to offer a more personalized service and to assist navigation. A "cookie" is a small text file that a website server stores on the user's hard drive. "Cookies" cannot identify a person and cannot transmit viruses.
Cookies help us, for example, to save user settings (language and the country from which they browse) for a future visit, and to manage the items you place in your cart when visiting our pages.

The site may occasionally send you relevant marketing offers by email or direct mail. If you do not wish to receive these offers, you can unsubscribe at any time.

11- Applicable law and jurisdiction

These terms of sale are subject to Spanish law. In case of difficulty or complaint regarding an order, the customer may contact Customer Service to find an amicable solution.

To resolve disputes arising from this contract or legal instrument, the parties may refer to the Consumer Arbitration Commission of Catalonia, which is responsible for appointing the arbitrator or arbitrators and administering the arbitration. If none of the above systems prove effective, the courts of the jurisdiction of Tarragona, Spain, shall have competence.

12. Modification of the general terms and conditions of sale

AGILANDIA may modify these terms at any time without notice, with immediate effect, by publishing the dates of the changes on this same page. If any part of these terms ceases to be applicable due to a legislative change or a judicial ruling, those clauses will be canceled; however, the rest will remain valid and in force.

By continuing to use our website, you accept these terms and any changes made to them, and you are required to frequently check this page. If you do not accept these terms, you must not continue to visit the Prints.fibracreativa.com website.
